By accessing our app, EatWell, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing EatWell. The materials contained in EatWell are protected by applicable copyright and trademark law.
You must be at least 18 years of age to use EatWell. By using the app, you confirm that you are 18 years or older.
EatWell offers optional premium features through in-app subscriptions. All subscriptions are processed and managed by Apple through the App Store. By subscribing, you agree to Apple's Standard End User License Agreement and their payment and renewal terms. Subscription management, including cancellation and refund requests, is handled directly through your Apple ID account settings.
You expressly acknowledge and agree that your use of EatWell is at your sole risk. You are solely responsible for any decisions you make based on information provided by the app, including but not limited to dietary choices, calorie targets, nutritional goals, and exercise routines. You agree to indemnify and hold harmless EatWell, its developers, affiliates, and suppliers from and against any claims, damages, losses, or expenses arising from your use of the app or reliance on any information it provides.
In no event shall EatWell or its suppliers be liable for any damages whatsoever, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, damages for personal injury or health outcomes, loss of data, loss of profit, or business interruption, arising out of the use or inability to use EatWell, even if an EatWell authorised representative has been notified orally or in writing of the possibility of such damage. This limitation applies to all information, data, and content provided through the app, including nutritional data from third-party sources and AI-generated estimates. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
All personal data you enter into EatWell, including food logs, weight entries, and goals, is stored exclusively on your device. EatWell does not transmit, collect, or store this data on any external server. If you delete the app, all locally stored data is permanently removed and cannot be recovered.
The materials appearing in EatWell could include technical, typographical, or photographic errors. EatWell does not warrant that any of the materials in EatWell are accurate, complete, or current. EatWell may make changes to the materials contained in EatWell at any time without notice. However, EatWell does not make any commitment to update the materials.
EatWell has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by EatWell of the site. Use of any such linked website is at the user's own risk.
EatWell may revise these terms of service at any time without notice. By continuing to use EatWell you are agreeing to be bound by the then current version of these terms of service.
These terms and conditions are governed by and construed in accordance with the laws of England and Wales, and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
EatWell is designed with a privacy-first approach. We do not collect, store, or have access to your personal data. All information you enter into the app, including your food diary, weight logs, nutrition goals, and personal details, is stored exclusively on your device and is never transmitted to our servers.
Your data lives on your device and nowhere else. There is no account creation, no login, and no cloud synchronisation. When you delete the app, all your data is permanently removed. We cannot recover it for you, as we never had access to it in the first place.
When you use the AI-powered calorie estimation feature, images and text descriptions you submit are transmitted to a third-party AI service provider for processing. This data is used solely to generate calorie and nutritional estimates and is not stored by EatWell beyond what is necessary to return results to you. We do not use this data for any other purpose.
EatWell uses anonymous analytics services to understand general app usage patterns, such as which features are used most often and how the app performs. This data is aggregated and anonymous -- it cannot be used to identify you personally. No personal health data, food logs, or weight information is included in analytics.
Our app may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites and cannot accept responsibility or liability for their respective privacy policies.
If you contact our support team, any information you voluntarily provide (such as an email address) will be used solely to respond to your enquiry. It will not be used for marketing purposes or shared with third parties.
We may update this privacy policy from time to time. Your continued use of EatWell will be regarded as acceptance of any changes.
