By accessing our app, EatWell, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing EatWell. The materials contained in EatWell are protected by applicable copyright and trademark law.
You must be at least 18 years of age to use EatWell. By using the app, you confirm that you are 18 years or older.
EatWell offers optional premium features through in-app subscriptions. All subscriptions are processed and managed by Apple through the App Store. By subscribing, you agree to Apple's Standard End User License Agreement and their payment and renewal terms. Subscription management, including cancellation and refund requests, is handled directly through your Apple ID account settings.
You expressly acknowledge and agree that your use of EatWell is at your sole risk. You are solely responsible for any decisions you make based on information provided by the app, including but not limited to dietary choices, calorie targets, nutritional goals, and exercise routines. You agree to indemnify and hold harmless EatWell, its developers, affiliates, and suppliers from and against any third-party claims, damages, losses, or expenses arising from your breach of these terms or your misuse of the app. Nothing in this section requires you to indemnify us for any liability arising from our own negligence or breach.
To the maximum extent permitted by applicable law, EatWell and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, loss of profit, or business interruption, arising out of the use or inability to use EatWell, even if an EatWell authorised representative has been notified orally or in writing of the possibility of such damage. This limitation applies to all information, data, and content provided through the app, including nutritional data from third-party sources and AI-generated estimates.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Because some jurisdictions do not allow certain limitations of liability, some of these limitations may not apply to you.
The food logs, weight entries, and goals you record in EatWell are stored on your device, and we do not sync, collect, or store this diary data on our servers, except as described in our Privacy Policy (for example, the AI calorie estimation, support, and crash-diagnostics features). If you delete the app, all locally stored data is permanently removed and cannot be recovered.
The materials appearing in EatWell could include technical, typographical, or photographic errors. EatWell does not warrant that any of the materials in EatWell are accurate, complete, or current. EatWell may make changes to the materials contained in EatWell at any time without notice. However, EatWell does not make any commitment to update the materials.
EatWell has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by EatWell of the site. Use of any such linked website is at the user's own risk.
EatWell may revise these terms of service from time to time. We will take reasonable steps to notify you of any material changes, for example through the app or on this page. By continuing to use EatWell after the changes take effect, you agree to be bound by the then-current version of these terms of service.
These terms and conditions are governed by and construed in accordance with the laws of England and Wales, and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

EatWell is designed with a privacy-first approach. The information you enter into the app — your food diary, weight logs, nutrition goals, and personal details — is stored on your device. There is no account, no login, and no cloud synchronisation, and this information is not sent to our servers. The only exceptions, each described below and limited to the data needed for that feature, are AI calorie estimation, support enquiries, and anonymous crash diagnostics.
Your food diary, weight logs, and personal details live on your device. We have no account system and do not sync this data to the cloud, so we cannot access or recover it. If you have device backups enabled (such as iCloud Backup or a computer backup), your app data may be included in those backups; this is managed entirely by Apple under your own account, and we have no access to it. When you delete the app, the data stored on your device is permanently removed.
When you use the AI-powered calorie estimation feature, images and text descriptions you submit are transmitted to a third-party AI service provider for processing, which may take place on servers located in other countries. This data is used solely to generate calorie and nutritional estimates and is not stored by EatWell beyond what is necessary to return results to you. We do not use this data for any other purpose.
If you grant permission, EatWell can read nutrition data from, and write nutrition data to, Apple Health. This information is exchanged directly with Apple Health on your device, is not transmitted to our servers, and is never used for advertising or shared with third parties. You can review or revoke EatWell's access at any time in the Apple Health app.
EatWell does not use third-party analytics or advertising services, and does not track you across other apps or websites. We do not build a profile of your activity and we do not sell or share your data for marketing.
To help us find and fix bugs, EatWell uses a crash-reporting service (Firebase Crashlytics) that collects limited technical diagnostic information when a problem occurs, such as your device model, operating system version, and the technical details of the crash. This is used only to improve the app's stability and does not include your food diary, weight logs, or other personal health information.
Our app may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites and cannot accept responsibility or liability for their respective privacy policies.
If you contact our support team, the email address and message you provide are used only to respond to your enquiry, on the basis of our legitimate interest in providing support. Your message may undergo automated categorisation to help route it to the right team, using a third-party service provider that may process it on servers located in other countries; your email address is not shared with that provider. Messages are delivered and stored through our email service provider. We do not use this information for marketing, and we retain support correspondence only for as long as needed to handle your enquiry and any follow-up. You may request access to, or deletion of, your support correspondence at any time by contacting us.
EatWell is intended for adults aged 18 and over. It is not directed to children, and we do not knowingly collect personal information from anyone under 18.
We may update this privacy policy from time to time. Your continued use of EatWell will be regarded as acceptance of any changes.
