Terms of use

1. Terms

By accessing our app, EatWell, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing EatWell. The materials contained in EatWell are protected by applicable copyright and trademark law.

2. Age Requirement

You must be at least 18 years of age to use EatWell. By using the app, you confirm that you are 18 years or older.

3. Use License

  1. Permission is granted to download one copy of EatWell per device for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile or reverse engineer any software contained in EatWell;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or "mirror" the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by EatWell at any time. Upon termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

4. Subscriptions and Payments

EatWell offers optional premium features through in-app subscriptions. All subscriptions are processed and managed by Apple through the App Store. By subscribing, you agree to Apple's Standard End User License Agreement and their payment and renewal terms. Subscription management, including cancellation and refund requests, is handled directly through your Apple ID account settings.

5. Disclaimer

  1. The materials within EatWell are provided on an 'as is' and 'as available' basis. EatWell makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  2. Further, EatWell does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to EatWell.
  3. Health Disclaimer: EatWell provides general nutritional information and calorie tracking for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before making any health-related decisions, including decisions related to food allergies, intolerances, medical conditions, or dietary requirements. EatWell is not intended for the diagnosis, treatment, cure, or prevention of any disease or condition, and is not suitable for individuals with or at risk of an eating disorder. If you have concerns about disordered eating, please seek help from a qualified professional. EatWell is not responsible for any health issues, injuries, adverse reactions, or damages of any kind resulting from reliance on the information provided in the app.
  4. Nutritional Data Disclaimer: Nutritional information displayed in EatWell, including calorie counts, macronutrient values, and other dietary data, is sourced from third-party food databases and external data providers. This information may be inaccurate, incomplete, outdated, or differ from actual nutritional values. EatWell does not independently verify the accuracy of data provided by third-party sources and makes no guarantees regarding its correctness. Users should always verify nutritional information through trusted sources, such as food labels from brands and manufacturers, particularly if managing a medical condition, food allergy, or specific dietary requirement.
  5. AI Estimate Disclaimer: The EatWell AI Estimate feature provides approximate calorie and nutritional information based on user-submitted images or descriptions of food items. These estimates are generated by artificial intelligence and are inherently approximate. They may be inaccurate, incomplete, or differ significantly from actual nutritional values. AI-generated estimates should not be relied upon as a sole source of nutritional information. EatWell is not responsible for any dietary choices, health outcomes, or decisions made based on AI-generated estimates. As a beta feature, EatWell AI Estimate may be modified, suspended, or discontinued at any time without prior notice.

6. Assumption of Risk

You expressly acknowledge and agree that your use of EatWell is at your sole risk. You are solely responsible for any decisions you make based on information provided by the app, including but not limited to dietary choices, calorie targets, nutritional goals, and exercise routines. You agree to indemnify and hold harmless EatWell, its developers, affiliates, and suppliers from and against any third-party claims, damages, losses, or expenses arising from your breach of these terms or your misuse of the app. Nothing in this section requires you to indemnify us for any liability arising from our own negligence or breach.

7. Limitations of Liability

To the maximum extent permitted by applicable law, EatWell and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, loss of profit, or business interruption, arising out of the use or inability to use EatWell, even if an EatWell authorised representative has been notified orally or in writing of the possibility of such damage. This limitation applies to all information, data, and content provided through the app, including nutritional data from third-party sources and AI-generated estimates.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Because some jurisdictions do not allow certain limitations of liability, some of these limitations may not apply to you.

8. Local Data Storage

The food logs, weight entries, and goals you record in EatWell are stored on your device, and we do not sync, collect, or store this diary data on our servers, except as described in our Privacy Policy (for example, the AI calorie estimation, support, and crash-diagnostics features). If you delete the app, all locally stored data is permanently removed and cannot be recovered.

9. Accuracy of Materials

The materials appearing in EatWell could include technical, typographical, or photographic errors. EatWell does not warrant that any of the materials in EatWell are accurate, complete, or current. EatWell may make changes to the materials contained in EatWell at any time without notice. However, EatWell does not make any commitment to update the materials.

10. Links

EatWell has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by EatWell of the site. Use of any such linked website is at the user's own risk.

11. Modifications

EatWell may revise these terms of service from time to time. We will take reasonable steps to notify you of any material changes, for example through the app or on this page. By continuing to use EatWell after the changes take effect, you agree to be bound by the then-current version of these terms of service.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of England and Wales, and you irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
